E-signing offer letters in the US, UK, EU and India

Updated 5 November 2026

Electronic signatures are legally binding for employment offers in almost all major business jurisdictions, provided they capture clear signer intent, identity verification, and an tamper-evident audit trail.

  • United States: The federal ESIGN Act (15 U.S.C. § 7001) and Uniform Electronic Transactions Act (UETA) validate typed or drawn e-signatures on employment agreements, provided signers consent and retain a copy.
  • United Kingdom: Under the Electronic Communications Act 2000 and Law Commission guidance, simple electronic signatures are fully valid for offer letters and employment contracts.
  • European Union: Regulation (EU) No 910/2014 (eIDAS) recognizes simple electronic signatures for employment agreements in most member states, with cryptographic timestamping.
  • India: The Information Technology Act 2000 (§10A) validates contracts formed through electronic records when signer identity and electronic authentication are documented.

What an audit certificate must contain

To withstand scrutiny during disputes or compliance audits, an electronic signature record should include signer IP address, browser user-agent, UTC timestamp, and a cryptographic SHA-256 hash of the signed PDF.

OneATS provides built-in standard electronic signatures with tamper-evident SHA-256 audit pages. It does not provide Qualified Electronic Signatures (QES). Consult legal counsel for documents requiring statutory digital certificates. Last reviewed: 5 November 2026. Explore our ATS with onboarding built in.
